Terms of Use

Last updated: 29 June 2026

1.Agreement to Terms

These Terms of Service (“Terms”) form a binding agreement between you and GermanLing (“we”, “us”) governing your use of the GermanLing application (the “App”). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2.Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, such as 16 in parts of the EEA) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or legal guardian who agrees to these Terms.

3.Description of Service

GermanLing is a language-learning app to help you prepare for telc/Goethe German examinations (levels A1–C2) through vocabulary, grammar, dialogues, reading, listening, writing, speaking, practice, and mock exams, including AI-assisted grading of writing and speaking.

4.Your Account

You are responsible for maintaining the confidentiality of your credentials and for activity under your account, and you agree to provide accurate information. Notify us promptly of any unauthorized use.

5.Acceptable Use

You agree not to:

  • use the App for any unlawful purpose;
  • attempt to gain unauthorized access to, disrupt, or reverse engineer the App or its systems (except where such restriction is prohibited by law);
  • copy, modify, or distribute App content without authorization;
  • abuse AI grading or attempt to circumvent usage limits; or
  • submit unlawful, infringing, or offensive content.

6.User Content and AI Grading

You retain ownership of the text and audio you submit (“User Content”). You grant us a limited license to process User Content solely to provide the service, including transmitting it to our AI grading provider for inference (see the Privacy Policy). You are responsible for your User Content and must not include sensitive personal information. AI-generated feedback and scores are provided for learning purposes only, may contain errors, and are not a substitute for an official examination result or professional advice.

7.Intellectual Property

The App and its content (text, graphics, logos, audio, and software) are owned by GermanLing or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial learning.

8.Subscriptions, Purchases & Cancellation

Premium features are offered via in-app purchase, billed through your Apple App Store or Google Play account. We offer auto-renewing subscriptions (weekly, monthly, and yearly) and a one-time lifetime purchase. The first 5 chapters of the A1 course are free forever without a subscription. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged within 24 hours before renewal. The lifetime purchase is a one-time, non-renewing payment. Manage or cancel subscriptions in your app-store account settings. Prices and plans are shown in the App at the point of purchase.

9.Refunds & Statutory Withdrawal Rights

Purchases are processed by the app stores, and refunds are generally subject to Apple’s and Google’s policies. Nothing in these Terms limits any non-waivable statutory rights you may have, including the EU/UK right of withdrawal for digital content and consumer-guarantee rights under Australian Consumer Law and Canadian consumer-protection legislation. Where you begin using digital content immediately, you may be asked to acknowledge that this can affect withdrawal rights to the extent permitted by law.

10.Consumer Rights (EU/EEA, Australia, Canada)

If you are a consumer, you benefit from mandatory protections under the law of your country of residence, and nothing in these Terms excludes or limits rights that cannot be excluded by law. For Australian users, our services come with guarantees that cannot be excluded under the Australian Consumer Law. Provisions below (including disclaimers and liability limits) apply only to the extent permitted by applicable law.

11.Content Accuracy & Educational Disclaimer

We strive for accurate, up-to-date educational content but do not guarantee it is error-free or that it will ensure success in any examination. The App is a supplementary learning tool and is not affiliated with or endorsed by telc gGmbH or the Goethe-Institut unless expressly stated.

12.Modifications to the Service

We may modify, suspend, or discontinue parts of the App at any time. Where required by law, we will give reasonable notice of material changes that adversely affect paid features.

13.Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access for breach of these Terms or to protect users or the service, with notice where required by law. Sections that by their nature should survive termination will survive.

14.Disclaimers

To the maximum extent permitted by law, the App is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

15.Limitation of Liability

To the maximum extent permitted by law, GermanLing will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data or profits, arising from your use of the App. Where liability cannot be excluded, it is limited to the amount you paid for the App in the 12 months before the claim. Nothing limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law.

16.Governing Law & Disputes

These Terms are governed by the laws of Germany, without regard to conflict-of-laws rules. If you are a consumer, you also benefit from any mandatory protections of the law of your country of residence, and you may bring proceedings in your local courts where the law so provides.

17.Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms in the App and update the “Last updated” date. Continued use after changes take effect constitutes acceptance.
